Important: By using MindDump, you agree to these Terms of Service. Please read them carefully before using our app.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the MindDump mobile application ("App," "Service," or "MindDump"). By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

MindDump is a personal journaling and mental wellness app that allows you to:

• Record thoughts via voice or text

• Receive AI-generated insights about your thoughts

• Track your mood, streaks, and achievements

• Access premium features via subscription

• Participate in a referral rewards program

3. Eligibility

You must be at least 13 years old to use MindDump. By using the Service, you represent that you meet this age requirement. If you are between 13 and 18, you must have permission from a parent or guardian.

4. Account Registration

4.1 Account Creation

To use MindDump, you must create an account by providing:

• Valid email address

• Secure password

• Or use Google OAuth or Apple Sign-In

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password

• All activities that occur under your account

• Notifying us immediately of any unauthorized access

4.3 Account Termination

You may delete your account at any time from the app settings. We may suspend or terminate your account if you violate these Terms.

5. Use of Service

5.1 Permitted Use

You may use MindDump for personal, non-commercial purposes to:

• Journal your thoughts and feelings

• Track your mental wellness

• Receive personalized insights

• Participate in gamification features

5.2 Prohibited Use

You agree NOT to:

• Use the Service for any illegal purpose

• Violate any laws or regulations

• Impersonate others or provide false information

• Attempt to hack, reverse engineer, or compromise the Service

• Upload malicious code, viruses, or harmful content

• Scrape, data mine, or extract data from the Service

• Share your account credentials with others

• Use the Service to harass, abuse, or harm others

• Circumvent any security features or access restrictions

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of all content you create ("Your Content"), including thoughts, voice recordings, and journal entries. By using the Service, you grant us a limited license to:

• Store and process Your Content

• Generate AI insights based on Your Content

• Use Your Content to provide and improve the Service

We will NEVER share Your Content with third parties for marketing purposes.

6.2 Our Content

MindDump, our logo, design, features, and all intellectual property are owned by us and protected by copyright, trademark, and other laws. You may not copy, modify, or distribute our intellectual property without permission.

6.3 AI-Generated Insights

Insights generated by our AI are provided for informational and self-reflection purposes only. They are not professional medical, psychological, or therapeutic advice.

7. Premium Subscription

7.1 Subscription Plans

MindDump offers premium features via subscription:

• Monthly Plan: Billed monthly

• Annual Plan: Billed annually (discounted)

7.2 Billing and Payment

• Subscriptions are billed through Apple App Store (iOS)

• Payment is charged to your Apple ID account

• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period

• Manage subscriptions in your Apple ID account settings

7.3 Refunds

Refunds are handled by Apple according to their policies. Contact Apple Support for refund requests. We do not have access to process refunds directly.

7.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds for unused time.

7.5 Price Changes

We may change subscription prices with 30 days' notice. Price changes apply to new subscribers immediately and existing subscribers at their next renewal.

8. Referral Program

8.1 Referral Rewards

Our referral program allows you to earn premium days by inviting friends:

• Referrer gets 7 days premium when someone uses their code

• Referred user gets 3 days premium

• Milestone rewards available at 3, 5, 10, 25, and 50 successful referrals

8.2 Referral Abuse

We reserve the right to revoke rewards and terminate accounts that abuse the referral program, including:

• Creating fake accounts

• Using bots or automated systems

• Spamming referral codes

9. Disclaimer of Warranties

IMPORTANT: MindDump is NOT a substitute for professional mental health care.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose

• Accuracy, reliability, or completeness of AI insights

• Uninterrupted or error-free operation

• Security or privacy (though we implement reasonable measures)

Mental Health Disclaimer:

• MindDump is a journaling and self-reflection tool, NOT therapy

• AI insights are for informational purposes only

• Do not rely on MindDump for medical or mental health decisions

• If you are in crisis, contact emergency services or a crisis hotline immediately

• Consult a licensed mental health professional for clinical concerns

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDDUMP AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

• Loss of data or content

• Loss of profits or revenue

• Emotional distress

• Personal injury

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless MindDump from any claims, damages, or expenses arising from:

• Your use of the Service

• Your violation of these Terms

• Your violation of any rights of another person or entity

12. Privacy

Your use of MindDump is also governed by our Privacy Policy, available at https://mind-dump.app/privacy. By using the Service, you consent to our data practices described in the Privacy Policy.

13. Third-Party Services

MindDump integrates with third-party services:

• OpenAI (voice transcription)

• Anthropic (AI insights)

• Supabase (data storage)

• RevenueCat (subscriptions)

• Google (OAuth)

• Apple (Sign-In)

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

14. Modifications to Service

We reserve the right to:

• Modify or discontinue any feature of the Service

• Change pricing for premium features

• Update these Terms at any time

We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance.

15. Termination

15.1 By You

You may terminate your account at any time by deleting it from the app settings. Upon termination:

• Your access to the Service ends immediately

• Your data will be deleted within 30 days

• Active subscriptions continue until the end of the billing period

15.2 By Us

We may suspend or terminate your account if:

• You violate these Terms

• Your account is inactive for over 2 years

• We discontinue the Service

• Required by law

16. Governing Law and Disputes

16.1 Governing Law

These Terms are governed by the laws of Texas, without regard to conflict of law provisions.

16.2 Dispute Resolution

Any disputes arising from these Terms or your use of MindDump shall be resolved through:

1. Informal Resolution: Contact us first at support@mind-dump.app to resolve the issue

2. Mediation: If informal resolution fails, participate in mediation

3. Arbitration: Binding arbitration if mediation fails

16.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or representative proceedings.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MindDump.

19. Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations to any affiliate or successor.

20. No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.
